1. Introduction and Acceptance

1.1 These Terms of Use (“Terms”) govern access to and use of the website [www.kalalawyers.com] of Kala Lawyers, a chamber of law practising before the High Court of Judicature for Rajasthan and courts, tribunals and fora subordinate thereto, with its office at Girah Shobha, 3-A Chopasani Road, Near Nasrani Cinema, Jodhpur, Rajasthan. [Hereafter, referred to as: (“Chamber”, “we”, “us”, “our”)].

1.2 By accessing or using the Website, you (“user”), [Hereafter referred to as ( “user”, “you”)] confirm that you have read, understood, and agree to be bound by these Terms, together with the Chamber's Disclaimer and Privacy Policy, each of which is incorporated herein by reference. If you do not agree with any part of these Terms, please discontinue use of the Website immediately.

2. Nature and Purpose of the Website

2.1 The Website is maintained solely to make available information about the Chamber, its members and its areas of practice, in a manner consistent with Rule 36 of the Bar Council of India Rules, to persons who, of their own volition and without solicitation or inducement by the Chamber, wish to know more about the Chamber.

2.2 Nothing on the Website constitutes, or is intended to constitute, advertising, solicitation, invitation or inducement of any kind. No part of the Website should be construed as the Chamber canvassing, touting, or otherwise soliciting professional engagement.

3. No Legal Advice; No Lawyer-Client Relationship

3.1 All information on the Website is provided for general informational purposes only and does not constitute, and must not be relied upon as, legal advice or a legal opinion applicable to any particular facts or circumstances.

3.2 The transmission, receipt or use of any information on, or through, the Website including through the Enquiry Form referred to in Clause 4 does not create, and shall not be construed as creating, a lawyer-client relationship between the user and the Chamber or any of its members. Such a relationship comes into existence only pursuant to a formal written engagement, entered into after the Chamber has conducted appropriate conflict-of-interest checks.

3.3 Users are strongly advised to obtain independent legal counsel in respect of their specific facts and circumstances before acting, or refraining from acting, on the basis of any material available on the Website.

4. The Enquiry Form

4.1 The Website provides a form through which a user may, entirely at the user's own initiative, voluntarily submit their name, telephone number and e-mail address, together with any further information the user chooses to provide, in order to make a general enquiry (“Enquiry Form”).

4.2 Submission of the Enquiry Form is voluntary and initiated solely by the user. The Chamber does not solicit such submissions, and the mere provision of a means for users to make voluntary enquiries shall not be construed as solicitation of work by the Chamber.

4.3 Personal information submitted through the Enquiry Form will be processed strictly in accordance with the Chamber's Privacy Policy.

4.4 The Chamber is under no obligation to respond to, act upon, or accept any enquiry received through the Website, and reserves the right, at its sole and absolute discretion, to decline any engagement, including (without limitation) on grounds of conflict of interest.

5. Intellectual Property

5.1 All content on the Website including text, graphics, logos, layout, design, and the selection and arrangement of such content is the intellectual property of the Chamber, or is used with the permission of the relevant rights holder, and is protected under applicable Indian intellectual property law.

5.2 A user may view and print pages of the Website solely for personal, non-commercial and informational use, provided that all copyright and proprietary notices are retained. No part of the Website may be reproduced, republished, distributed, modified, framed, mirrored, or otherwise commercially exploited without the Chamber's prior written consent.

6. Third-Party Links

6.1 The Website may, from time to time, contain links to third-party websites provided for reference or convenience only. The Chamber does not control, endorse, or accept responsibility for the content, accuracy, or data practices of any linked third-party website. Access to any such website is entirely at the user's own risk.

7.1 The Website and its content are made available on an “as is” and “as available” basis. The Chamber makes no representation or warranty of any kind, express or implied, as to the accuracy, completeness, currency, or reliability of any information contained on the Website.

8. Limitation of Liability

8.1 To the fullest extent permitted under applicable law, the Chamber, and its partners, associates, members and employees, shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary loss or damage of any nature whatsoever arising out of, or in connection with, access to or use of the Website, or reliance placed on any information contained therein.

9. Governing Law and Jurisdiction

9.1 These Terms shall be governed by, and construed in accordance with, the laws of India. Subject to Clause 9.1, the courts at Jodhpur, Rajasthan, and the High Court of Judicature for Rajasthan, shall have exclusive jurisdiction to entertain any dispute arising out of, or in connection with, these Terms or the use of the Website.

10. Amendments

10.1 The Chamber reserves the right to amend, modify, or update these Terms at any time, at its sole discretion and without prior notice. The amended Terms will be posted on the Website together with a revised “last updated” date, and continued use of the Website following such posting constitutes acceptance of the amended Terms.

11. Severability

11.1 If any provision of these Terms is held by a court or tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
